This Privacy Policy is part of each of the Terms of Use and User Agreement ("Agreement") between you ("User" or, as appropriate, "you") and the Aruba Tourism Authority ("ATA") and the Aruba Hotel and Tourism Association ("AHATA"). Collectively, AHATA and ATA are referred at different times as "we" and "Aruba.com".

When using our website Aruba.com or the Aruba.com forum ("the Site"), your personally identifiable information ("Personal Data") may be processed. We are committed to safeguarding your privacy in that respect. This Site collects two kinds of information regarding users:

  1. Personal Data (such as your name, date of birth, e-mail adress, country); and
  2. information that does not personally identify you (such as the number of users who log on this Site on a daily basis).

2.1 Social security numbers

We will not and do not collect your social security number on this Site. Do not provide your social security number on this Site, or to any party that says it is from this Site.

2.2 Children and our underage policy

This Site is not intended for nor directed to persons under the age of 14. We do not knowingly collect Personal Data from anyone under 14 years of age, except for the limited circumstances described below in the section on underage policy. Registration is available to individuals between the ages of 14 and 18 with prior consent from a parent or legal guardian. In the event a person under the age of 14 submits a question to us on this Site and identifies his or her age, we may use the person’s email address for the sole purpose of responding to the person’s question on a one-time-only basis. However, we will not knowingly use the person’s email address to re-contact the person and we will delete it from our records once we have responded. If we become aware that we have unknowingly collected Personal Data from a person under the age of 14, we will make reasonable efforts to delete such information from our records.

Does Aruba.com process Personal Data through Cookies?

While we do not store Personal Data in cookies, we may process Personal Data with other data from cookies. For example, cookies that contain your ID used for personalization can be (automatically) tied with Personal Data from after you've registered on the Site. This would be primarly used for enhancing the personalization engine in real time or secondarily for occasional data analysis.

3. Parties whom we share your data with

3.1 Non-identifiable information (no Personal Data)

Non-identifiable information is information that (i) can be aggregated where the information of a population is represented instead of a single individual, (ii) where the identity of the individual is not known, and (iii) where the identity of the individual cannot be inferred from the obtained information. We share non-identifiable (demographic) information about our user base with our partners and advertisers. Sharing this information permits our partners and advertisers to target our goods and services to a specific demographic (for example, any unmarried, over-40 year old scuba divers).

3.2 Personal Data

In some cases, as stated below in the overview of data sharing partners, we share your Personal Data with external parties but we never sell your Personal Data to any external party. Additionally, we may automatically tie data that is not personally identifiable (such as analytics and other aggregate data sources) with data that is part of your Personal Data to improve your customer experience (for example, cross-referencing your location data with demographic and aggregated data sources to personalize your experience on the Site). We may also use the same cross-referecing technique to evaluate our advertisement strategies. 

We reserve the right to disclose Personal Data without your consent and without notice to you as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our Site. 4. Storage and retention of your Personal Data

As shown above in the overview of the purpose of Personal Data, we retain your Personal Data in databases in accordance to our retention policy and applicable laws. We may also need to retain certain information to prevent fraudulent activity; to protect ourselves against liability, permit us to pursue available remedies or limit any damages that we may sustain; or if we believe in good faith that a law, regulation, rule or guideline requires it.

With respect to storage, we use various applications for obtaining and storing certain data. To guarantee your privacy, these applications are subject to strict regulations. Most data is stored within the European Union. In respect of data that is forwarded to non-EU countries, we only use companies that provide sufficient protection in line with European legislation. In a number of countries this is prescribed. For example, for United States parties that fall within the ‘Privacy Shield’. 5. Security of your Personal Data

Aruba.com employs appropriate physical, administrative and technical safeguards to help protect the confidentiality and integrity of information collected by this Site and to reduce the risk of loss, misuse, unauthorized access disclosure or modification of such information. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. 7. Modifications to this privacy policy

If we decide to modify or supplement our Privacy Policy, we will post those changes to this privacy statement, the homepage, and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. Privacy Policy changes will apply to the information collected from the date we post the revised Privacy Policy to the Site, as well as to existing information held by us.
